Deposits: To reserve a date for equipment or performances, a non-refundable deposit of $100 must be paid in advance. No date will be reserved until a deposit is received. Payment of deposit constitutes acceptance of all terms of this agreement by the Client whether physically signed by them or not.
Payment: Other than deposits, the balance due must be satisfied in cash only on the day of the event and before the start of entertainment.
Cancellation: Cancellation notices must be received at least two weeks in advance. Clients canceling 14 days or less prior to the scheduled event date are responsible for 100 percent of the total package price and authorize NYC Birthday Clowns to obtain the necessary funds.
Rain Dates: NYC Birthday Clowns does not provide rain dates.
Rescheduling: If Client needs to reschedule the event due to illness or extreme situations, they assume a rescheduling fee of 20 percent the total package price. This fee is not applicable toward the balance.
Electricity: Client agrees to provide electricity as required for music, cotton candy, or other equipment.
Non-Performance: NYC Birthday Clowns and its employees are not liable for any failure to perform as a result of sickness, accident, traffic, riot, strike, act of God, or any other condition beyond the Company’s control which reasonably prevents the Company‘s performance. In such event, the Client shall be entitled only to a full refund of all sums paid.
Parking: NYC Birthday Clowns is not responsible for parking garage fees. If entertainers are unable to find parking on the street, host will assume responsibility for parking fees.
Performance: NYC Birthday Clowns has the right to modify the contract in order to accommodate the number of children, should there be more or less children than stated on the contract.
Time: Entertainment time starts as soon as the entertainer(s) arrive at the party location. The client cannot modify their scheduled party time without consent from the Company.
Client is responsible for providing one medium sized table, 2 chairs, and an electrical outlet. Please have this ready when the entertainers arrive.
